KOKO Development, LLC v. Phillips & Jordan, Inc., Case No. 23-2234 (2024). The Eighth Circuit Court of Appeals affirmed the lower court’s decision to grant summary judgment for my client, who had completed a large construction project for the plaintiff. The plaintiff developers brought suit and ultimately did not disclose the necessary experts in the case. My client and I moved for summary judgment, which was granted. The Eighth Circuit Court of Appeals agreed with the lower court’s analysis and affirmed dismissal of the claims, which amounted to several million dollars.
